Questions

Straight Answers

Is this a real IRS program?

Yes. It's Section 45B of the federal tax code. Congress created it to offset the payroll tax employers pay on their staff's tips. It's a permanent credit claimed on IRS Form 8846. Not a loophole, not a gray area.

Who qualifies?

Restaurants, bars, nightclubs, hotels, caterers and cafes where tipping is customary, your staff are W-2 employees who report their tips, and you pay FICA on those tips. If your servers and bartenders get tipped, you very likely qualify.

What does it cost?

Nothing upfront. The fee is a percentage of what's recovered, disclosed before you sign anything. No recovery, no fee.

Will claiming it trigger an audit?

Claiming a credit the law gives you is not, on its own, a reason for an audit. Our filing partner builds every claim with full payroll documentation so it stands up if the IRS ever has questions.

Why hasn't my CPA mentioned this?

Most payroll companies don't file it, and most CPAs don't specialize in it. It takes tip-level payroll data and a specific filing process, so it gets missed. That's the gap our filing partner fills.
